Penalties and Fines: Point System (Moving Violations)

Any driver who is convicted of a moving violation, including offenses committed while operating a motorized bicycle or a vessel/boat, will be assessed points for each conviction in accordance with the N.J.S.A Point Schedule.

Violations on the Palisades Interstate Parkway

413.1 Vehicle speed limits. (as approved 2/26/01)

(b) A rate of speed in excess of 50 miles an hour on the Palisades Interstate Parkway from the New York - New Jersey State Line to the southern terminus of the Parkway is prohibited.  Every person who shall violate any of the provisions of such rules and regulations shall be liable to a penalty for each offense to a fine as follows:

(1) 51 - 59 $78.00

(c ) A rate of speed in excess of 25 miles an hour on park roads (not including Palisades Interstate Parkway) is prohibited.  Every person who shall violate of the provisions of such rules and regulations shall be liable to a penalty for each offense to a fine as follows:

(1) 26 - 34 $78.00

(2) 35 - 39 $88.00

(3) 40 - 44 $98.00

(4) 45 - 49 $193.00

(5) 50 - 54 $213.00

(6) 55 - 59 $233.00

(7) 60 mph and over, Court Appearance Required

Point Violation Notices
MVC will automatically send an Advisory Notice if your point total is between 6 and 11. For a total of 12 or more points, MVC will issue an automatic Notice of Scheduled Suspension.

Points Remain on your Driver History Record
Even after your license is restored, all point violations remain on your permanent Driver History Record. However, this record differs from your current driver status; your current status equals the point total minus the point credit deductions.

414 Penalties for violations of rules and regulations:

414.1 Every person who shall violate any of the provisions of such rules and regulations shall be liable to a penalty for each offense to a fine of not more than $1,000.00, other than as set forth in 413.1 b & c or imprisonment in the county jail for a term of not more than 30 days, or both.

Interstate Compacts

New Jersey belongs to two Interstate Compacts. Member states exchange information to ensure driver compliance with the law and that they receive penalties for violations.

The Nonresident Violator Compact

  • includes 44 states* and the District of Columbia,
  • assures nonresident motorists the same rights and privileges as resident motorists,
  • requires drivers to fulfill the terms of traffic citations received in member states or face the possibility of license suspension in their home state,
  • provides that nonresident drivers have due process protection and cannot be detained out -of -state.

*Alaska, California, Michigan, Montana, Oregon and Wisconsin are not members.

Note: The compact does not apply to parking or standing violations, highway weight limit violations, and violations of Hazmat transportation laws.

  

The National Driver License Compact

  • exchanges violation information with other states* and the District of Columbia,
  • ensures that out -of -state violations become part of your NJ driving record. Two points are assessed for each moving violation.

*Georgia, Massachusetts, Michigan, Tennessee and Wisconsin are not members.

 

If you received a New Jersey traffic ticket you have the constitutional right to plead "not guilty" and defend yourself in Municipal Court.
